Confirm Suspect Identification (Form 277)

This document is the New Orleans Police Department's "Eyewitness Identification Form" (NOPD Form 277), which is used to document and standardize the process when witnesses attempt to identify potential suspects.

The form serves several crucial purposes:

  1. Reducing Bias: The form establishes a "blind administration" procedure where the officer showing the lineup explicitly states they are not involved in the investigation and have no knowledge of which photo/person might be the suspect.
  2. Standardized Instructions: It provides a script that officers must read to witnesses that:
    • States the suspect may or may not be in the lineup
    • Emphasizes the importance of clearing innocent people
    • Explains that people's appearance may change
    • Instructs witnesses on how the procedure works
  3. Sequential Presentation: It documents that photos/individuals were shown one at a time (rather than all at once), which research shows reduces false identifications.
  4. Documentation of Results: The form records:
    • Whether the witness identified someone
    • Which photo/individual was identified
    • The witness's exact statements about the identification (verbatim, in quotes)
    • Who else was present during the identification process
  5. Procedural Integrity: The form helps ensure proper protocols are followed:
    • All photos/individuals must be shown even if an identification is made early
    • Witnesses are instructed not to indicate their decision to others
    • A supervisor must review the process
  6. Legal Protection: By documenting the entire process with signatures from the witness, administering officer, and supervisor, it creates a record that can be used in court to establish the reliability of any identification made.
