Minor Zoning Map Adjustment Appeal

The purpose of a minor map adjustment is to eliminate split-lot classifications, shift boundaries to coincide with a newly created lot line as part of a subdivision or resubdivision, or create uniform boundary lines on the Official Zoning Map or Future Land Use Map of the Master Plan.

An application for a minor map adjustment to the Official Zoning Map shall be considered by the Director of the Department of Safety and Permits within forty-five (45) days. The Director of the Department of Safety and Permits may approve or deny the application after evaluating it against the approval standards of Article 4, Section 4.7.E of the Comprehensive Zoning Ordinance.

An aggrieved party may appeal the Director of the Department of Safety and Permits decisions on minor map adjustments to the Official Zoning Map to the Board of Zoning Adjustments within forty-five (45) days of the Director’s decision. Note that appeals of decisions of the Executive Director of the City Planning Commission on minor map adjustments to the Future Land Use Map of the Master Plan may be appealed to the City Planning Commission within forty-five (45) days of the Executive Director’s decision.

  • Single and Two-Family Residential Projects: $150
  • Three or more Residential Unit Projects: $250
  • Commercial or Mixed-Use Projects: $250
  • Rehearing: Same as Original Fee

Acceptable forms of in-person payment include: Checks, Cashier’s Checks, Money Orders, Visa, MasterCard, and Discover. Please make all checks and money orders payable to City of New Orleans.

Process

  1. File a completed application with a “planner on duty” within forty-five (45) days of the date of the decision.
  2. Board of Zoning Adjustments staff have ten (10) days to review your application for completeness. They may request additional information from you in order to mark the application “complete” and schedule it for a hearing.
  3. Board of Zoning Adjustments staff will notify you when your application has been docketed.
  4. The official journal of record will publish notice of the request, and Board of Zoning Adjustments staff will mail notification postcards to nearby property owners and residents.
  5. The Director of the Department of Safety & Permits will prepare a summary report, which will be made available to you and the public on the Wednesday prior to the hearing.
  6. The Board will hear the appeal at the first available BZA meeting after the application is marked “complete.” Meetings are held the third Monday of every month at 10:00 a.m., in the City Council Chamber (unless otherwise noticed). Applicants should plan to attend the meeting to speak on behalf of the appeal.
  7. The Board will take action on your application. Within ten (10) days of the Board’s action, the staff will send you a written record, or resolution, of the Board’s action.
  8. You or any other aggrieved party may appeal the Board’s decision to Civil District Court within thirty (30) days of the date on the resolution. BZA decisions cannot be appealed to the City Council.
