Statement In Response to IAFF Local 632 Press Release

The New Orleans Fire Department was made aware of a press release issued to the media by the New Orleans Fire Fighters Association, IAFF Local 632 President Aaron Mischler, in which he alleges that the Department has engaged in improper conduct in regard to several cases related to firefighters on medical leave.
It is unfortunate that Aaron Mischler has chosen to employ inflammatory language and political tactics, in lieu of collaboration and communication with the department. It is particularly concerning that he has assigned words such as “disposable” to our firefighters. The men and women in the NOFD are not disposable. They are the foundation of the Department and the reason we are able to fulfill our mission of protecting lives and property.
While the Department cannot discuss specific medical information related to the firefighters referenced in Aaron Mischler’s statement, we can provide general facts to clarify the situation. The firefighters in question have injuries or medical conditions that, according to their treating physicians, prevent them not only from performing firefighting duties, but also from engaging in any form of administrative or transitional duty. Additionally, their physicians have been unable to provide a definitive timeline regarding when, or if, these individuals will be medically cleared to return to work.
The Department has and will continue to follow all state, civil service and departmental policies, as we work to ensure that all firefighters receive the support that they are fully entitled.
In regards to the reinstatement process for retired firefighters, Louisiana Revised Statute 33:2550 clearly outlines that “any regular employee who retires from a position in the classified fire service as a result of an injury or medical condition which prevents them from performing the essential functions of their job and who applies for reemployment shall be reemployed in a position of the class in which he was employed immediately preceding his retirement.” The details for reinstatement in the statue are clear. The Department will work with each person individually if, and when they are medically cleared and ready to return to an active role in the department.
The New Orleans Fire Department values every firefighter and recognizes the sacrifices they make in service to this city. We remain committed to treating our members with dignity and respect, complying with all applicable laws, and supporting our firefighters throughout their careers and beyond. The Department deeply appreciates the dedication, courage, and service of its firefighters and will continue to honor that commitment through both word and action. I am here and available to have an open dialogue with Aaron Michler and representatives from IAFF Local 632 to discuss any concerns and to ensure that they have a good understanding of the department policies, state laws and civil service rules.
