NON-COMMERCIAL SHORT-TERM RENTAL (NSTR)

SPECIAL EXCEPTION PROCESS

IS DISCONTINUED

This is to notify the public that the City Planning Commission will no longer process pending applications for Non-Commercial Short-Term Rental Special Exceptions, effective immediately.

On September 5, 2024, the New Orleans City Council introduced Motion No. M-24-493, which established the “Non-Commercial Short-Term Rental Special Exception Interim Zoning District” (IZD), which prohibited the issuance of NSTR Special Exceptions. The prohibition applied to any NSTR Special Exception application received after September 19, 2024. An application was deemed to have been received if a request for a Neighborhood Participation Plan (NPP) neighbor list was submitted by the deadline.

Following the introduction of the IZD, NSTR Special Exception applications submitted prior to September 19, 2024 continued to be processed pursuant to Section 21.8.C.18.r of the Comprehensive Zoning Ordinance (CZO). 373 NSTR Special Exception applications were received prior to the deadline and were eligible for processing. As of October 1, 2025, the CPC has processed 267 of the eligible applications.  96 eligible applicants have not submitted the necessary follow-up materials for their applications to be processed.

Reasons for Discontinuation:

On March 27, 2025, the City Council adopted Ord. No. 30311, M.C.S., which established new regulations for NSTRs, including removing Section 21.8.C.18.r from the CZO. Accordingly, there are no longer any regulations in the CZO which allow for Special Exceptions to the CZO’s NSTR density limitations.

In accordance with the CPC’s NPP Resource Guide, NPP neighbor lists are valid for a period of one year. The reason for this limitation is that it is important that the list be as current as possible, and the Assessor’s records, from which the lists are drawn, are updated annually. Accordingly, as of October 9, 2025, all the outstanding NSTR Special Exception applications no longer have valid NPP neighbor lists.

Based upon these two factors, the CPC no longer has the authority to process any of the remaining NSTR Special Exception applications.
