For decision appeal applicants wishing to provide supplemental materials pertinent to their argument (beyond the minimum application requirements), all such materials must be provided at the time of application submittal. The submittal of additional information after the application filing deadline will result in automatic deferral of the appeal. This is meant to ensure that the Department of Safety and Permits has access to the full appeal application and supporting documents for review and to produce the summary report in advance of the Board of Zoning Adjustments hearing.
This policy is effective immediately.
Note: There is no change to the minimum application filing requirements of 1) the completed application form, 2) the Department of Safety and Permits decision, as allowed under Article 4.8.B and dated no more than 45 days prior to application submittal, and 3) a written statement from the applicant explaining the basis of the appeal and providing evidence of an error in application of the law or a conflict in the law. The above policy also does not apply to letters of support or opposition from the public, which are subject to the written comment deadline.
