2018 Short Term Rental Study

Background

On May 24, 2018, The City Council adopted Motion No. M-18-194 directing the City Planning Commission to conduct a study on the existing Short Term Rental regulations in the CZO, and the correlating requirements of the City Code, to determine if modifications are warranted.  

The City Planning Commission conducted a public hearing on the study and the Interim Zoning District at the July 10, 2018, City Planning Commission meeting. On August 20, 2018, the City Council granted the City Planning Commission an extension for the Short Term Rental Study to review materials, refine recommendations, and complete the study. The study was heard at the City Planning Commission’s regular public hearing on September 25, 2018. The Commission decided to defer action on the study to allow additional public comment and further review of the staff’s recommendations. At a special hearing on October 3rd, 2018, the City Planning Commission heard additional public comment and voted to forward the study to the City Council with a few minor amendments. 

The City Planning Commission forwarded the 2018 Short Term Rental Study to the City Council for consideration on October 5, 2018. The City Council may choose to hold its own public hearing on the Study, though it is not required.

Short Term Rental Interim Zoning District (M-18-195)

On May 24, 2018, the City Council passed Motion M-18-195 to create an Interim Zoning District (IZD) prohibiting the following uses in the Historic Core, Historic Urban, Central Business Districts, MU-1 Mixed Use Medium Intensity, and MU-2 Mixed Use High Intensity Districts:

  • Any issuance or renewal of a Temporary Short Term Rental permit or license.
  • Any issuance of a Commercial Short Term Rental permit or license for STR-use on the first floor of a multi-story building that can or may contain residential uses on subsequent floors.

The IZD provides the ability for property owners to appeal the prohibition through a process that includes City Planning Commission staff review and City Council consideration.

The Council directs the CPC to conduct a follow-up study of the City's STR regulations. 

The City Council directs the CPC to conduct a follow-up study of the City's short term rental regulations. The Council stated in its Motion (M-18-86) that almost a year has passed since the Short Term Rental regulations have become effective, providing sufficient data to analyze Short Term rental laws to determine community impact.  

April 24, 2018

CPC holds a public hearing to solicit comment on the study.

The City Planning Commission, in accordance with Motion M-18-86, holds a public hearing to solicit comments on the 2018 Short Term Rental Study.

May 24, 2018

The Council rescinds the original study motion and provides updated scope for the STR Study.

The City Council adopted Motion No. M-18-194 directing the City Planning Commission to conduct a study on the existing Short Term Rental regulations in the CZO, and the correlating requirements of the City Code, to determine if modifications are warranted.  The City Planning Commission is directed to complete the study within 120 days of the passage of the motion and conduct the public hearing within 60 days of the passage of the motion.

May 24, 2018

The Council creates an IZD to temporarily prohibit the issuance or renewal of certain licenses while the CPC conducts the STR study.

July 10, 2018

The CPC holds a public hearing to solicit comment on the study.

The City Planning Commission, in accordance with Motion M-18-194, holds a public hearing to solicit comments on the 2018 Short Term Rental Study.

August 20, 2018

The Council extends the deadline for the study

Considering that the scope of the 2018 Short Term Rental Study, requested in Motion M-18-194, is quite broad and carries great weight for the City, the City Council has granted the City Planning Commission an extension to complete the Study. 

September 17, 2018

Original deadline for written comments

Original deadline for written public comments. The CPC extended this deadline to Friday, September 28th at their September 25th public hearing.

September 25, 2018

STR Study considered by CPC

On September 25th, 2018 the City Planning Commission deferred action on the STR Study to a special meeting on Wednesday, October 3rd at 1:00 pm.

September 28, 2018 Deadline for written comments

The deadline for written public comments was 5pm CT, Friday, September 28th.

October 3rd, 2018 STR Study considered by CPC

The City Planning Commission considered the recommendations of the Study at a Special Meeting on Wednesday, October 3rd at 1:00 pm in the City Council Chambers. 

October 5, 2018

CPC transmits study and public comments to the City Council

The City Planning Commission forwarded the 2018 Short Term Rental Study to the City Council for consideration on October 5, 2018.

City Council considers STR Study

The City Council may choose to hold its own public hearing on the Study, though it is not required. The City Council may direct the CPC to consider all or part of the recommendations as text changes to the Comprehensive Zoning Ordinance.
